Polystyrene Food Service Ware Prohibited

The City of Manhattan Beach recently adopted an ordinance prohibiting the use of polystyrene food service ware. Businesses affected by this ordinance received a letter from the city this week.

The ordinance was adopted by City Council on September 10, 2013 and is effective as of October 10, 2013. To allow the businesses time to transition away from already purchased polystyrene food service materials, or contracts to purchase these materials within the year prior to the effective date of the ordinance, widespread enforcement will not take place until April 10, 2014. Per the adopted ordinance, all businesses must indicate their compliance with the ordinance on their annual business license renewal application.

This ordinance was adopted to reduce litter and to ensure that all food service containers are recyclable or compostable. Any business not having recycling collection services at is encouraged to contact Waste Management at (310) 830-7100. Waste Management will complete a business waste audit at no charge to setup recycling and to address solid waste management needs. Recycling can reduce disposal costs as well as ensure that customers can properly recycle.

In the coming months, City staff will prepare a fact sheet that reviews the prohibited and the allowable types of food containers.
